What if Home Depot had refused to rent a truck to Sayfullo Saipov?

John Miller, NYPD deputy commissioner of intelligence and counterterrorism, said Wednesday: “We did extensive outreach to the truck rental business. We visited over 148 truck rental locations in this area. The industry has had a high level of awareness on this matter from the NYPD.” And “Miller said that if a company is suspicious of a would-be renter, they usually delay or simply deny a rental to let police investigate.”

Really? The companies deny rentals to suspicious characters? Is that so?

    Think how the phone call to the NYPD would go:
    “Hello is that the NYPD some one has just tried to rent a truck from us. Yes we do rent out trucks. Yes he had a valid driving licence, and valid ID, and could pay.
    But the thing is he had a beard and was a bit dark, we think he may be a Muslim, so we did not serve him. We think you should investigate him in case he is a jihad Muslim terrorist. Could you please hurry, before he goes to some other truck hire company, who are not as civic minded as we are.”
    What crime do you think the NYPD would be investigating?
    Who do you think would be the one to go to jail for being a racist bigoted Islamophobia?
    Which company would have riots out side and be set on fire?
    Which company would be shut down and have to pay out millions?
    What do you think the headlines would be all over the world?

    As far as I know hiring a truck – or stealing one – is not that hard in NYC that he could not find one within two hours. How fast does John Miller think the NYPD work?

    As a former HD employee, I can tell you there is nothing in the manual or training that tell you not to rent to anyone that has a valid ID and credit card. They mentioned not to rent to anyone under the influence but that was it.

    Don’t rent to a Muslim, better call your attorney. It will be worse for you than not baking a cake for some gays.

      One of the thing I never understood about one of the “gay cake cases” was in at less in the case in Belfast, Ashers Baking Company were asked to make a Bert and Ernie cake. Two copyrighted characters which it would have been illegal for the baker to use under copyright law. But they still found guilty of discrimination for obeying the copyright law.

        1. I don’t believe the bakery ever made a copyright-based claim in that case. They were not objecting to Bert and Ernie, they were objecting to the wording on the cake and the purpose of the cake.
        2. Also, they accepted the order and then canceled it two days later, which makes it a breach of contract issue.
        3. Also, they were stupid enough to state to the customer that it would be sinful and at odds with the Bible. Their statements were the core of the discrimination case. If they’d made different statements, things might have gone differently.

        So no, they weren’t found guilty of discrimination for obeying the copyright law, they were found guilty of discrimination for breaching the contract based on their personal beliefs. Which arguably they should have been able to do, but which fits the definition of discrimination based on how the laws were written.

        And BTW Sam, your question is actually about trademark law, not copyright law. Specific images can be copyrighted, characters can’t; characters are trademarked. Thought you should know in case you decide to explore this issue further, since the two sets of laws are very different.

    I call bullshit….just because I have a beard and an attitude they are going to turn me down renting a truck?….well fuck them, I’ll just steal one….and why does it have to be a truck?….I guarantee, you can do just as much damage with a rental car….the only way to cut down on this crap is to have never let the bastards in here to begin with….our leaders fucked up….now all we can do is be on the lookout, carry a firearm, and be ready to use it….such is the world in which we live….
