Kentucky Judges Pre-Signed Blank Legal Documents So CPS Could Take Custody of Kids on Nights and Weekends

Kentucky’s Cabinet for Health and Family Services—the state agency that provides child protective services—has a practice of obtaining blank emergency custody orders pre-signed by judges. Social workers then fill out the documents with the necessary information after they’ve been signed by a judge and then use them to take custody of children from parents who have come under investigation. Let me repeat that: no judge actually reviews these orders, or the evidence used to justify separating a family, before signing them.

This practice is a galling abuse of parents’ rights and basic civil liberties. It only came to an end after an investigative report by WDRB-41 spotlighted the practice:

    Then the FEDS pay these state CPS’s 8-10k a head for kids that are placed in foster homes to complete the “self-funding” process! They usually don’t keep the ratty, drug addicted-parented ones, they keep the ones they are sure they can “sell” to those foster homes. Foster homes that sometimes have up to 10 or 12 kids residing in them. Just another gubment racket for gubment pensions!

    If they can do this “for the good of the children”, one wonders what will happen under the Red Flag laws to “protect us from the Evil Guns”, since it’ll “save just one life.”

    My wife was a teacher for 30 years, working in resource; she can tell you horror stories. One thing that was consistent was the remarkable ability of CPS/DSS to be proactive and pig headed where it wasn’t warranted and complacent and lackadaisical when it was.

    Evil abuses of power like this happen and continue for one very simple reason. Those engaging in them have ZERO fear of suffering ANY consequences for their criminality and abuse of power. Until that simple fact changes things will never improve and will for the most part get worse.

    Nobody’s said a word about the TOTAL LACK of due process here. Why? Maybe because we all know deep down the constitution is ashes. The system has been weaponized to keep certain parents in line. Meanwhile they only take the kids they should be taking as a last resort – after the kids have suffered abuse and/or damage. So many kids live in squalor with abusive parents are ignored the this same system until it is too late. Any kids that do make it to a foster system are mostly doomed because the foster systems are total crap. I think it was in KY where kids were actually caged. A quick search reveals cases in OH and TX. I did not see the KY case but this was several years ago. Besides these are the “regular” foster parents. For them it is a business. This is not to say there are no good foster homes out there but they are vastly outnumbered by others filling the demand for empty beds. Sadly, I would never, EVER participate again. Anyone considering becoming a foster parent asking me for advice would get a strong “stay far away” from me.

    seems to me this resigned-never-reviewed order could be destroyed by a higher court review.

    prison for those involved, including the crooked judges. this isnt how American justice works.
