It’s a start

WASHINGTON (AP) — The Trump administration on Thursday published new visa rules aimed at restricting “birth tourism,” in which women travel to the U.S. to give birth so their children can have a coveted U.S. passport.

Applicants will be denied tourist visas if they are determined by consular officers to be coming to the U.S. primarily to give birth, according to the rules in the Federal Register. It is a bigger hurdle to overcome, proving they are traveling to the U.S. because they have a medical need and not just because they want to give birth here. Those with medical needs will be treated like other foreigners coming to the U.S. for medical treatment and must prove they have the money to pay for it — including transportation and living expenses.

    it’s simple really – revoke citizenship by birth to non-citizens. and do so retroactively.
    these half-measures arent sufficient.

    • Passport says:

      The US can’t revoke a passport that easily. The Constitution says Article 1 section 9 “No Bill of Attainder or ex post facto Law shall be passed.” Taking them away retroactively would constitute an ex-post facto, or after-the-fact, law.

      The Bill of Attainder would mean passing a law against an individual (Donald Trump for example), or a class of individuals (such as Trump Voters). But it’s more complicated than just that.

      To realistically end the anchor baby process, it would take a veto-proof majority in both houses of Congress, and then to further pass that the law not be subject to review by the courts.

    It is only custom that such a thing as anchor baby exists. There is no law to that effect. Easy to do as Other Jack suggests. Just takes someone with the balls.

      You are correct. NOTHING says you’re born here you’re a citizen. I was looking for the exact terminology but could not find it. Won an argument at work with it recently but damn my memory.

    Good start – I don’t understand why that policy still remains. We have plenty of legal Americans already, its not like our country’s borders are expanding as well. Pretty much doubled since the late 1950’s, our infrastructure is way behind our population needs.

    A plus for the tree huggers – Americans are far more wasteful of resources, the less of us, the better for the environment. So begone and enjoy your new home. If you are deadset on becoming American, they are accepting LEGAL residents already.

    The 14th Amendment was for slaves who were born to insure that the were considered US citizens. Even American Indians were not included nor were the children born here of foreign diplomats. It sure as heck shouldn’t apply to the children of illegal aliens.
    Unfortunately this has never been challenged in the courts and needs to be or Congress needs to amend immigration law.
