Veteran has guns seized in case of mistaken identity

One of the many laws they are pushing are so-called “red flag” laws where someone can petition the courts to have someone’s guns taken away without any due process by claiming the person is a danger to themselves or others. And the person being served with the court order doesn’t even know it until the cops are at the door. Then the person has to spend their own money and time to fight it, and has to prove their innocence before the court in order to get their rights back.

The crazed prohibitionists try to claim there is due process and that these laws will save lives, while they mock anyone who dares to bring up dystopian scenarios where people are wrongly accused. Except what happens when the wrongly accused are actually served with these orders in real life?

    It happened to Jon Carpenter, in St. Cloud, Florida. He happened to have the same name as a homeless drug addict who was threatening an elderly woman with a gun

    yeah, i’m sure Mr. Homeless guy has a gun permit for that gun.

    The law allows for even anonymous tips to police. How long before anti-gun hysterics start red-flagging complete strangers “for the cause”? How long before angry neighbors, pissed off ex-wives and ex-girlfriends start abusing these laws?

    I think I read where read flag laws have been used over 5,000 times already, and 2,000 times in Connecticut alone.

      Play by their rules. The moment a state puts in red flag laws and anonymous tip lines, call them for every single dem who votes for it; call them on every single LEO who thinks it’s a good idea; call them on every single lawyer and da who gives Red Flag laws their blessing; call them for every single family member of these fascists. Let’s remember that the dems have in almost every case of Red Flag laws specifically left out any mechanism for punishment against false tips.

      At the same time have someone (I’m thinking Judicial Watch) start inundating them with
      FOIA requests to see how many times certain politicians are reported or better yet show that LE is keeping a separate list of those allowed to practice their rights and those who aren’t.

      Either there’s going to be a quieter push or the politicians and LE are going to form even more no-go zones in every community.

      Why aren’t everyone of you who live in a State with red flag “laws” dropping a dime on every commie official in your State? If you can call in anon, make a list of every commie you can find, get a burner cell phone and start calling to report some person of having guns and being very crazy. WTF? What is wrong with all of you? Don’t you realize we are at WAR? Today? Start acting like it and become offensive. Turn everything the commies do back at them.

      And then start getting even.

    If you are not represented in a court proceeding, either by your presence or by an attorney acting on your behalf, then these red flag laws are unconstitutional direct violations of the 4th and 6th amendments. What I don’t understand is why there is no case before the SJC on this basis.

      Because no one in government or poo lice departments are interested in the Constitution. I thought that was obvious by now!
